Lake Tahoe vacation rental rules, town by town

Lake Tahoe vacation rental rules depend on who governs the address

Lake Tahoe vacation rental rules aren't one set of rules. The lake sits in two states and five counties, and each town's rules come from whichever government is in charge of that address. In some places that's a city. In others it's the county.

That matters most if you're buying a home and counting on rental income, or selling one that has been rented. Two homes a few minutes apart can fall under different governments, with different permits, limits and waiting lists.

The rules are strict and they change. I don't summarize them here, because a summary goes out of date. This page tells you who sets the rules for each town and sends you straight to that government's own page.

Who sets the rules, town by town

Find the town, then follow the link to that government's own rules page. Links were checked in October 2026.

Where two governments are listed, it depends on which side of a boundary the home sits.

Towns where the city sets the rules

These are run by a city or town government.

City of South Lake Tahoe uses the term vacation home rentals (VHRs).
Homes inside the city limits of South Lake Tahoe, including the Tahoe Keys. The city changed its rules in 2026, so read the current version on the city's page.

Town of Truckee uses the term short-term rentals (STRs).
Homes inside the Truckee town limits. Homes outside the town limits fall under the county they sit in.

Carson City uses the term short-term rentals.
All of Carson City, which is a combined city and county government. Historically, Carson City hasn't allowed vacation rentals. Ask the city's Planning Division, as the laws are changing.

Towns where the county sets the rules

These towns aren't cities of their own, so the county sets the rules.

El Dorado County uses the term vacation home rentals (VHRs).
South Shore homes outside the South Lake Tahoe city limits, such as Montgomery Estates, Meyers, Tahoe Paradise, Christmas Valley and the Upper Truckee area, plus the El Dorado County side of Tahoma. A South Lake Tahoe mailing address doesn't mean the home is inside the city. The parcel decides.

Placer County uses the term short-term rentals (STRs).
Tahoe City, Tahoe Vista, Kings Beach, Carnelian Bay, Homewood and the Placer County side of Tahoma.

Douglas County, Nevada uses the term vacation home rentals (VHRs).
Stateline, Zephyr Cove and Glenbrook, which are in the county's Tahoe Township. The county's vacation rental program is written for the Tahoe Township, the lake side of the county. Historically, Gardnerville and Minden haven't allowed vacation rentals. Ask the county, as the laws are changing.

Washoe County, Nevada uses the term short-term rentals (STRs).
Incline Village and Crystal Bay.

What I do, and what to ask before you buy

Before you count on rental income from any home, I confirm which government covers the parcel and what the current rules are for that address. A mailing address won't tell you. The parcel does.

These are the questions worth asking early:

  • Is a vacation rental allowed at this address at all?
  • Does the home have a permit now, and does that permit pass to a new owner?
  • Is there a cap or a waiting list for new permits?
  • Does the HOA allow short-term rentals? An HOA can be stricter than the city or county.
  • What inspections, fees and taxes come with a permit?

If you're selling a home that has been a vacation rental, I find out what a buyer can and can't take over, so the listing says it accurately.

There's more in buying a house in Lake Tahoe, buying a second home and what I check for buyers.

Ask me about Lake Tahoe vacation rental rules

If you're weighing a home against the Lake Tahoe vacation rental rules for its town, tell me the address or the area, or call or text me at 530-208-7081. I'll confirm who governs it and what the current rules say.

This page is general information. It isn't legal or tax advice. Vacation rental rules change, and each government's own page is the official word. Confirm the rules for the specific property before you buy, sell or rent.

Frequently Asked Questions

Who sets the vacation rental rules in South Lake Tahoe?

The City of South Lake Tahoe sets them for homes inside the city limits, including the Tahoe Keys. Homes outside the city limits, such as in Montgomery Estates or Meyers, fall under El Dorado County.

Who sets the vacation rental rules in Incline Village?

Washoe County. Incline Village and Crystal Bay aren't cities, so the county sets the short-term rental rules.

Are the rules the same all around Lake Tahoe?

No. Each city and county writes its own, and they differ on permits, limits and waiting lists. The rules also change, so I confirm them for the specific address.

Can an HOA ban vacation rentals even if the county allows them?

An HOA can have its own rules that are stricter than the city's or county's. Read the HOA's rules for any home you're considering.
